Terms of Service
Terms of Service
The standard terms behind every booking: deposit, payment, guest count, cancellations, food safety. Your signed agreement always controls.
Agreement to these terms
These Terms of Service ("Terms") govern your use of achefstouch.com (the "Site") and set out the standard terms on which A Chef's Touch Catering Service ("A Chef's Touch," "we," "us") provides catering and event services. By using the Site or booking an event, you agree to these Terms. Your signed catering agreement or proposal controls your event; if it conflicts with these Terms, the signed agreement wins.
Ballparks, proposals, and bookings
Numbers given by our scheduling assistant or in an initial conversation are approximate and are not a quote. A written proposal is valid for the period stated on it. Your event is reserved only when we receive your signed agreement and the deposit below. Menu items, prices, and availability may change until your proposal is signed.
Deposits, payment, and standard charges
The figures below apply to most events and appear in your proposal. Your proposal is the final word.
| Item | Standard term |
|---|---|
| Deposit (offsite catering) | $750, due with your signed agreement. Reserves your date. |
| Balance | Due 30 days before the event. We may decline to execute an event whose balance is unpaid. |
| Drop-off catering | $100 delivery and setup charge. |
| Tasting | $100, credited in full to your event when you book. |
| Servers | $20 per hour per server, per your proposal. |
| Bartender | $150 at our Cocoa Village event space; $250 offsite. For offsite events the client supplies alcohol and mixers; disposable bar supplies (cups, straws, napkins, fruit, ice) are available at $1.95 per guest. |
Payments are made through the invoice we send you. Prices do not include Florida sales tax where it applies, or gratuity, which is at your discretion.
Guest count and portions
Every order is prepared and portioned generously for the contracted guest count, the number in your signed agreement or confirmed in writing by the date stated there. That number is what we shop, cook, staff, and bill for. If your count grows, tell us as early as you can; increases are accepted subject to availability and billed at the proposal rate. Decreases after the confirmation date do not reduce the amount due.
Cancellations and date changes
The deposit is non-refundable. It is transferable to a new date within one year of the original event date if you give us at least one week's notice. Cancellations after the balance is paid are handled under your signed agreement; where that agreement is silent, payments made are retained to cover purchased food, labor, and lost bookings. If we must cancel for reasons within our control, we refund all payments received for that event.
Food safety and allergies
We cook in a licensed commercial kitchen and handle food under Florida health regulations. Our kitchen handles common allergens, including wheat, dairy, eggs, soy, tree nuts, peanuts, fish, and shellfish; we take care with dietary requests but cannot guarantee any dish is free of an allergen. Tell us about allergies and dietary needs in writing before your confirmation date.
Food is safe to eat for a limited time after service. For drop-off orders you are responsible for holding temperatures once we leave. Leftovers at staffed events are released to the client at the client's request and risk.
Venues, access, and day-of conditions
For events at your home or a venue, you are responsible for giving us the access, power, water, space, and time stated in your proposal, and for any venue fees, permits, or insurance the venue requires. Difficult-access venues may carry additional labor charges, quoted in advance. We are not responsible for delays caused by venue restrictions, weather at outdoor events, or conditions outside our control, and will work with you in good faith to adapt.
Alcohol
Where a bartender is provided, alcohol is served only to guests of legal drinking age with valid identification, and our staff may refuse service to anyone who appears intoxicated. The client is responsible for alcohol purchased by the client and for guests' conduct.
Photographs and reviews
We may photograph food and table setups at your event for our portfolio and website; we will not publish identifiable images of you or your guests without permission. Reviews shown on the Site are reproduced from public review platforms.
Text messages
By opting in to text messages you agree to receive texts from us about your inquiry or event and, where you have chosen, our offers. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase. See our Privacy Policy.
Use of the Site
The Site and its content (text, photographs, logos, menus) belong to A Chef's Touch or its licensors and may not be copied or reused for commercial purposes without permission. You agree not to misuse the Site, interfere with its operation, or submit false information through its forms. The Site is provided "as is"; we do not warrant that it will be error-free or uninterrupted.
Limitation of liability
To the fullest extent permitted by Florida law, A Chef's Touch's total liability for any claim arising from an event or from the Site is limited to the amount you paid us for that event. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
Governing law
These Terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Brevard County, Florida, and you consent to their jurisdiction.
Changes and contact
We may update these Terms; the effective date above shows the current version. Events already booked remain under the terms in their signed agreement. Questions: [email protected], (321) 638-0022, or A Chef's Touch Catering Service, 607 Florida Avenue, Cocoa, FL 32922.
